Delaware LLC Formation Form Your LLC

Stripe Atlas and our Non-US Founder Package cost almost the same for a Delaware LLC, so the choice comes down to what you need the company for. Atlas is $500 with the state fee included and is built around venture-backed startups. Our package is $399 plus Delaware's $110 fee and is built around foreign owners who want an LLC, a no-SSN EIN, and someone to draft their bank application. After year one, the agent costs $100 annually at Atlas and $99 here. We sell our package, so take this comparison as coming from a competitor.

Quick verdict

Choose Stripe Atlas if you're forming a C-corp for fundraising, want 83(b) and SAFE paperwork handled, or would keep $5,000 in Stripe Treasury to earn back the fee.

Choose our package if you're forming an LLC to run a business, not to sell shares, and want your bank application written for you and a clear no-SSN EIN process.

What Stripe Atlas offers

The numbers for a Delaware LLC

  • Atlas, year one: $500, everything above included.
  • Our package, year one: $399 plus $110, for $509.
  • Difference: $9 in Atlas's favor, or the full $509 if Stripe refunds your fee after the Treasury deposit.
  • Each year after: $100 at Atlas, $99 with us.
  • Delaware's LLC tax: $400 for 2026, due by June 1, not included by either of us.

We're not the cheaper option here. The case for our package is what's in it.

How our package handles the hard parts

  1. An EIN without an SSN, explained. The Atlas page doesn't say how it handles applicants without an SSN. Our SS-4 follows the IRS instructions for foreign applicants; after your e-signature, it goes out by fax.
  2. A bank application that's done for you. We turn your checkout answers and Certificate of Formation into a finished application for our partners, ready the moment the SS-4 is signed. You give the go-ahead, and it's submitted then and there, independent of the IRS. Our partners decide on each one, so no account is guaranteed.
  3. Timing you can plan around. The IRS usually issues the EIN two to eight weeks after the fax, and it lands in your dashboard.

Your ongoing obligations

Each June 1, Delaware collects its flat LLC tax. Neither Atlas nor our package pays it for you, and neither prepares US tax returns, so a foreign-owned single-member LLC should have a tax professional ready for Form 5472 and the pro forma 1120.

FAQ

Are Stripe Atlas and your package really about the same price?

Yes. Atlas is $500 with Delaware's filing fee and year-one registered agent built in. Ours is $399 plus the $110 filing fee, $509 total, also with the agent for year one. Renewals are $100 a year at Atlas and $99 with us.

What's the Stripe Treasury refund?

Stripe refunds the $500 Atlas fee once you deposit $5,000 into Stripe Treasury. For a founder who'd hold that balance anyway, Atlas can cost nothing up front.

Can I choose a C-corp?

At Atlas, yes; it forms Delaware LLCs and C-corps. Our package forms LLCs only, so if investors want a C-corp, Atlas is the right tool.

Does either one include a mailing address or tax filing?

No. Atlas includes neither a mail address nor Form 5472 help, and our package includes neither a general mailing address nor tax filing. Our registered office does receive and forward your official papers.

Which is better if I just need a bank account for my LLC?

It depends on the account you want. Atlas steers you toward Stripe Treasury. Our team drafts the whole application for our partners, includes your formation documents, and submits it on your approval, before your EIN has arrived. Approval rests with our partners.
